1. Who we are

2. Scope

These Terms & Conditions govern every order placed through this website. By placing an order you accept them in full. We may update them at any time; the version in force is the one published on this page at the time of your order.

3. Products

We sell software licences and related digital services for professional and hobby simulators. Unless stated otherwise on the product page, a licence is granted for the use described in the chosen licence tier (for example Home, Edu, Pro, Integrator for FS Instructor). A licence is personal, non-transferable and does not transfer any intellectual-property rights. Reverse engineering, redistribution and resale are prohibited unless expressly permitted by an Integrator / reseller agreement.

4. Prices and tax

Prices are shown in euros (€). VAT is not applicable — Article 293 B of the French General Tax Code (franchise en base de TVA); no VAT is charged or recoverable. For business customers established in another EU country, the reverse-charge mechanism may apply and it is your responsibility to account for any tax due in your country. Any bank or currency-conversion fees are borne by the customer.

5. Ordering and payment

Payment is taken at the time of the order, securely through PayPlug. We never receive or store your full card details. An order is confirmed once payment is authorised and you receive an order-confirmation email. We may refuse or cancel an order in case of suspected fraud, a pricing error, or a breach of these Terms; in that case any amount already taken is refunded in full.

6. Delivery

All products are delivered electronically. For current products, your licence key and download link are sent by email within one business day (Paris time). For products marked as instant delivery, the download and key are available immediately after payment. No physical goods are shipped. Please make sure your email address is correct and check your spam folder.

7. Right of withdrawal (consumers)

Our products are digital content supplied without a physical medium. In accordance with Article L221-28 13° of the French Consumer Code (and EU Directive 2011/83), by starting the download or requesting immediate delivery you expressly agree that performance begins before the end of the 14-day withdrawal period and you acknowledge that you thereby lose your right of withdrawal. Where delivery has not yet started, a consumer may withdraw within 14 days by contacting contact@fsinstructor.com.

9. Licence keys, updates and support

A licence entitles you to updates of the purchased major version and to email support during business hours (extended support may be included with Pro / Integrator tiers or a separate support contract). Licence keys must be kept confidential; keys that are shared publicly or used beyond the licensed scope may be revoked.

10. Warranty and liability

Software is provided “as is”. We make no warranty that it will be uninterrupted or error-free or compatible with every third-party system or simulator configuration. Consumers keep the benefit of the statutory guarantees of conformity and against hidden defects under French law. To the fullest extent permitted by law, our total liability for any claim relating to a product is limited to the price paid for that product. We are not liable for indirect or consequential loss, loss of data, or downtime of a simulator.

11. Intellectual property

All software, text, images and branding on this website are the property of FS Instructor or its licensors and are protected by copyright. Nothing on this website grants any right to use them except the licence you purchase.

12. Governing law and disputes

These Terms are governed by French law. Before any legal action a consumer may use, free of charge, the consumer mediation service: [TODO: nom et coordonnées du médiateur de la consommation]. Consumers may also use the European ODR platform at ec.europa.eu/consumers/odr. Failing amicable settlement, the competent courts are those of the seller’s place of business, subject to the mandatory rules protecting consumers.
